Pop Quiz: Is it actually against the law to break the speed limits or drive whilst not wearing a seatbelt in England?
.
The answer may surprise you!
First some clarification:
To understand this fully, we first have to learn something about law, that there is a difference between lawful and legal.
Lets explore this a little further:
Lawful: This applies to human beings and as such is common law. The only basic principles people need to adhere to are those of natural law, which are mirrored in common law.
Common Law: Never harm or cause Loss
Legal: This applies to corporations (commercial law), these are not laws, but acts and statues given the force of law, by the consent of the governed.
IE It’s not law, but it can be given the force of law if you agree!
Since acts and statues are not meant for human beings, how do the English courts practice commercial law on us?
When your parents registered your birth, a bond was created in your name, and floated on the stock exchange. This is essentially a legal fiction, created in your name, a corporation if you like. The Robin Clapworthy corporation for example.
When you go to court, its this legal fiction that they are addressing. They will ask “MR ROBIN CLAPWORTHY” if I reply yes, guess what I have agreed to represent?
